DrLOUIE Affiliate Program: General Terms

This Agreement governs participation in the DrLOUIE Awin Affiliate Program ("Program"). By applying to or participating in the Program, you as the publisher ("Publisher," "you") agree to comply with the terms outlined herein, which supplement the Awin Advertiser Master Agreement.

1. Program Eligibility and Participation

1.1 Approval: DrLOUIE reserves the absolute right to approve or reject any publisher application at our sole discretion. We may also terminate a Publisher's participation in the Program at any time for any violation of this Agreement.

1.2 Age Requirement: Publishers must be at least 18 years of age to participate.

1.3 Ethical Conduct: Publishers must conduct all activities in a professional and ethical manner that aligns with the values and brand image of DrLOUIE.

2. Promotional Guidelines & Restrictions

2.1 Paid Search (PPC) Policy 

  • - Publishers are strictly prohibited from bidding on any DrLOUIE branded keywords for search engine marketing campaigns. This includes, but is not limited to: DrLOUIE, Dr LOUIE, drlouie.ca, Dr. Louie
  • - Any variations, misspellings, or foreign language equivalents of our brand name.
  • - Using our brand name in combination with other keywords (e.g., "DrLOUIE sale," "Dr LOUIE reviews").
  • - Using our trademarks in the ad copy, title, or display URL of any paid search ad.
  • - Direct linking to drlouie.ca (or any of its subdomains) from any paid search ad. All traffic must be directed to the Publisher's own website first.
  • - Publishers are required to add "DrLOUIE" and "Dr LOUIE" as negative keywords to all their paid search campaigns to prevent their ads from appearing on branded searches.

2.2 Voucher, Discount, and Coupon Code Policy

  • - Publishers may only promote voucher codes that have been explicitly issued to them or to the affiliate channel through the Awin platform.
  • - Promoting codes obtained from other channels (e.g., customer newsletters, social media, other partners) is strictly forbidden.
  • - Publishers must clearly state the terms and expiration date of any voucher code. Expired codes must be removed or clearly marked as expired.
  • - Voucher codes must not be presented using misleading language or formats, such as "click to reveal," that suggest a discount is available when one is not.
  • - Using our brand name in combination with terms like "coupon," "code," "promo," "discount," etc., in website subdomains or social media handles (e.g., drlouie-coupons.com) is prohibited.

2.3 Social Media Policy

  • - Publishers are welcome to promote DrLOUIE on social media channels.
  • - However, Publishers may not create social media accounts or pages that could be reasonably interpreted as being an official presence of the DrLOUIE brand. This includes using our brand name, logo, or variations in the page name, handle, or profile picture.

2.4 Prohibited Content and Practices 

Publishers must not engage in any of the following activities:

  • - Spam: Any form of unsolicited commercial emailing or messaging is strictly prohibited.
  • - Misrepresentation: Publishers must provide honest information about our products and pricing. False claims, misleading statements, or inaccurate representations are forbidden. 
  • - Illegal or Unethical Content: Your website(s) and promotional materials must not contain any content that is libelous, defamatory, obscene, harassing, hateful, or promotes illegal activities or discrimination
  • - Software & Adware: Publishers may not use adware, spyware, toolbars, or any forced-click software to generate commissions. All clicks must be user-initiated.
  • - Cookie Stuffing: The practice of setting the Awin tracking cookie without a user's clear, affirmative action to click a link is prohibited.

 

3. Intellectual Property

  • - Publishers are granted a non-exclusive, revocable right to use the DrLOUIE logos, banners, and creative assets provided within the Awin platform (available in the "Toolbox" or "My Creatives" section) for the sole purpose of promoting our Program.

  • - Unauthorized alteration of our creative assets is not permitted. You may not use our trademarks, brand name, or copyrighted material in any way that implies endorsement or a formal partnership beyond participation in this Program.

 

4. Program Modifications

DrLOUIE reserves the right to modify any of the terms and conditions in this Agreement at any time. We will provide notice of any changes through the Awin platform. Your continued participation in the Program following a change notice will constitute your binding acceptance of the revised terms.

 

5. Disclaimer of Liability

DrLOUIE will not be liable for any indirect, special, or consequential damages (or any loss of revenue, profits, or data) arising in connection with this Agreement or the Program, even if we have been advised of the possibility of such damages.

 

6. Performance Review & Inactivity

DrLOUIE reserves the right to review affiliate accounts every three (3) months. Affiliates are expected to demonstrate minimum activity by generating at least one (1) tracked sale or piece of promotional content within each six-month review period. Affiliates who remain inactive during this timeframe may, at DrLOUIE’s sole discretion, be removed from the program without prior notice. Inactive affiliates may reapply to the program at any time, subject to approval.
